Congress Faces Critical Deadlines as 2026 Session Begins
As lawmakers return from the holiday recess, Congress is confronted with a demanding agenda and pressing deadlines that could significantly impact governance. With a looming deadline to prevent another government shutdown, the expiration of Affordable Care Act (ACA) subsidies, and ongoing tensions surrounding U.S. actions in Venezuela, 2026 is set to be a pivotal year.
Funding Deadline and Legislative Challenges
Congress has less than a month to avert a government shutdown, which could occur if lawmakers fail to agree on a stopgap measure or a full-year spending package for 2026. The urgency is heightened by the need to fund government operations, particularly in an election year when both parties are acutely aware of voter sentiment. Three of the twelve appropriations bills have already passed as part of the agreement to end the previous shutdown, but the remaining nine face significant hurdles.
Senate Minority Leader Chuck Schumer emphasized the importance of collaboration, stating, “Democrats want to fund the appropriations, the spending bills, all the way through 2026. We want to work in a bicameral, bipartisan way to do it.” Schumer’s remarks signal a willingness among some lawmakers to cooperate, despite the tight margins in the House, where recent retirements have narrowed the Republican majority.
Controversy Over Venezuelan Policy
Another significant issue on the legislative agenda involves the administration’s recent operation to capture Venezuelan President Nicolás Maduro. This operation has sparked bipartisan debate about the future of U.S. involvement in Venezuela, with many Democrats and some Republicans arguing against the use of military force without congressional authorization. The White House has characterized the operation as a law enforcement action, which has garnered support from several Republicans.
As Congress deliberates the implications of this operation, discussions are underway regarding a potential war powers resolution that would restrict further military actions in Venezuela without legislative consent. The outcomes of these discussions could shape U.S. foreign policy in the region.
Healthcare Subsidies and Political Pressure
Compounding these challenges is the expiration of ACA subsidies, which has added urgency to legislative discussions as millions of Americans face potential premium increases. Some moderate Republicans in swing districts have expressed concern about voter backlash and are pushing for a vote on extending these subsidies or developing an alternative plan.
Lawmakers are expected to vote this week on a bill to extend the subsidies for three additional years. The measure’s success hinges on the support of key Republican legislators who previously backed a Democratic-led petition, indicating a potential for bipartisan cooperation. However, previous attempts to address the expiring credits have faced significant opposition in the Senate, complicating efforts to reach a consensus.
Epstein Files and Legislative Oversight
Another contentious issue is the administration’s handling of the Epstein files, which have been released by the U.S. Department of Justice in a piecemeal fashion, causing frustration among lawmakers. Despite the Epstein Files Transparency Act mandating a complete release by December 19, the DOJ has cited the volume and complexity of the materials as reasons for the delays.
Lawmakers, including Rep. Thomas Massie (R-Ky.) and Rep. Ro Khanna (D-Calif.), have voiced their dissatisfaction with the DOJ’s compliance and the heavy redactions applied to the documents. A group of senators has also sought an audit of the DOJ’s adherence to the law, reflecting a growing demand for transparency and accountability in government operations.
As Congress navigates these complex issues, the stakes are high for both parties. With the 2026 midterm elections approaching, lawmakers are acutely aware that their actions in the coming weeks will resonate with voters and could determine the balance of power in Congress. The interplay of funding negotiations, foreign policy, healthcare, and transparency in governance will shape the legislative landscape as the new session unfolds.
