During the signing of the order, Trump stated, “All over the country they’re burning flags… through a very sad court… they called it freedom of speech… When you burn the American flag it incites riots… You burn a flag, you get one year in jail.” His comments reflect a strong stance against what he views as disrespect toward American symbols.

The executive order directs Pam Bondi, the Attorney General, to seek legal avenues to challenge the Supreme Court’s 1989 ruling, which determined that flag burning is protected under the First Amendment. Bondi expressed confidence that prosecutions could occur without violating this ruling, stating, “We will do that without running afoul of the First Amendment,” according to USA Today.
The White House justified the order, citing images of flag burning occurring amidst violent demonstrations, including protests in Los Angeles against U.S. Immigration and Customs Enforcement actions. Trump criticized these protests, particularly those where demonstrators displayed Mexican flags while burning the American flag. He emphasized that individuals who burn the flag should face a one-year prison sentence.
“My Administration will act to restore respect and sanctity to the American Flag and prosecute those who incite violence or otherwise violate our laws while desecrating this symbol of our country, to the fullest extent permissible under any available authority,” the executive order states.
