Former Professor Sues Clemson University Over Free Speech Violation

A former professor has initiated legal action against Clemson University, alleging wrongful termination linked to a social media post that criticized the late conservative commentator, Charlie Kirk. The lawsuit, filed by the American Civil Liberties Union of South Carolina (ACLUSC) on behalf of Dr. Joshua Bregy, contends that his dismissal violated his First Amendment rights.
According to the complaint, which was filed recently, Dr. Bregy served as an assistant professor in the university’s Department of Environmental Engineering and Earth Sciences from January 2023 until his firing in September 2025. The ACLUSC asserts that Dr. Bregy was the only qualified faculty member to teach critical courses in this department, raising concerns about the university’s ability to meet the educational needs of its students following his dismissal.
Allen Chaney, Legal Director of the ACLUSC, emphasized the importance of free speech for public employees, stating, “The First Amendment protects the rights of public employees to speak in their personal capacity on important public topics.” He criticized Clemson University for allegedly succumbing to political pressures, suggesting that the institution should uphold constitutional protections rather than yield to external demands.
The lawsuit further alleges that Clemson University compromised its commitment to free speech and acted hastily in response to political threats, including potential funding cuts. The ACLUSC argues that the university’s actions reflect a troubling pattern of capitulation to political influence, which undermines academic freedom.
Dr. Bregy and the ACLUSC are seeking reinstatement for the professor at Clemson University, along with financial compensation for damages incurred due to his termination. As the case progresses, it raises significant questions about the balance between free speech and institutional response to political pressures in academic settings.
This legal battle highlights the ongoing debate surrounding academic freedom, free speech, and the role of universities in fostering open discourse. As the situation unfolds, it will be essential to monitor how it impacts not only Dr. Bregy’s career but also broader discussions about the rights of educators within public institutions.
