Chester County Resolves Election Chaos by Counting Provisional Ballots

Chester County has announced it will count the majority of provisional ballots cast following a chaotic Election Day on November 4, 2023. The decision comes after numerous challenges faced by voters, particularly independent and third-party candidates, who were forced to use provisional ballots due to issues with poll books. With over 12,000 provisional ballots submitted, the county’s election board has determined that most of these votes will be counted to rectify the situation.

During a nearly six-hour meeting, the Chester County election board, comprised of Commissioners Eric M. Roe, Josh Maxwell, and Marian D. Moskowitz, listened to testimonies from voters and poll workers who described significant confusion and frustration. Many voters expressed their concerns about receiving provisional ballots despite believing they were eligible to vote normally. The board acknowledged that the high number of provisional ballots was largely a result of poll book errors that omitted the names of independent and third-party voters.

The board’s decision to count these ballots was not without controversy. The Chester County Republican Committee initially objected to counting more than 1,000 ballots but later withdrew some of its objections. GOP representatives emphasized the importance of adhering to legal standards, arguing that counting ballots lacking required signatures or secrecy envelopes could undermine voter confidence in the electoral process.

“People’s ballots deserve to be counted in this circumstance,” stated Josh Maxwell, the Democratic chair of the board. He stressed that the county must address its mistakes to maintain trust in the electoral system.

Provisional ballots serve as a safeguard for voters who may encounter issues on Election Day, such as being at the wrong polling place or having already requested a mail-in ballot. However, these ballots often face a higher rejection rate than regular ballots due to additional requirements, including the need for voters to complete a secrecy envelope and sign in multiple places.

As the situation unfolded, several voters expressed frustration at having their eligible votes potentially rejected. One poll worker, Edith Jones, shared her distress over inadvertently directing voters to fill out provisional ballots without providing them the necessary secrecy envelopes. “I directed voters to fill out their provisional ballots but forgot to provide them with the required secrecy envelope,” she said, clearly upset about the impact of the mistake.

In addition to the objections raised by the Republican Committee, there were calls for improvements to the electoral process to prevent similar occurrences in future elections. Dolores Troiani, an attorney for the GOP, argued that counting certain provisional ballots could set a dangerous precedent that might allow for bypassing established electoral safeguards.

Despite the heated discussions, the board ultimately voted to count the majority of provisional ballots, recognizing the extraordinary circumstances that led to their issuance. The decision reflects a commitment to ensuring that eligible voters are not disenfranchised due to administrative errors.

Moving forward, county officials have indicated their intent to implement changes to improve the integrity and functionality of the voting process. Marian Moskowitz emphasized that disenfranchising voters, especially when it is not their fault, should never be an option.
