Judge Orders Hearing on Backpack Search in Mangione Case

A federal judge has ordered an evidentiary hearing concerning the search of a backpack belonging to Luigi Mangione, who is accused of murdering Brian Thompson, the CEO of UnitedHealthcare. This decision, made by Judge Margaret Garnett on Monday, reverses her prior ruling that deemed the hearing unnecessary after considering arguments presented during a hearing on Friday.

The upcoming hearing will focus on whether the Altoona police acted lawfully when they seized and searched Mangione’s backpack inside a McDonald’s in Altoona, Pennsylvania, during his arrest. In her court order, Judge Garnett stated she took into account both the legal arguments and the serious nature of the charges against Mangione, which include a possible capital offense.

Testimony from an Altoona police officer is expected to address the department’s procedures regarding the handling of personal property seized during an arrest. The judge emphasized that the prosecution is not required to call officers directly involved in Mangione’s arrest as witnesses. The hearing is anticipated to occur within the next two weeks.

In previous court proceedings, several Altoona officers testified regarding the evidence obtained during Mangione’s arrest, including the backpack that allegedly contained the murder weapon. Mangione’s defense team is arguing for the exclusion of this evidence from both his federal and state cases, claiming the search was conducted without a warrant.

On Friday, Mangione’s lawyers also requested that the court prevent prosecutors from pursuing the death penalty in his federal trial. If the death penalty remains a possibility, the trial could be postponed until December 2026 or January 2027. Without that option, Judge Garnett indicated that Mangione might face trial as early as October 2026.

Currently, no trial date has been set for Mangione’s state murder case, which is expected to take precedence. Mangione has pleaded not guilty in both federal and state courts regarding the charges stemming from the incident on a New York City sidewalk in 2024.
