DeSantis Defies Court Order, Moves Forward with Alligator Alcatraz

Florida Governor Ron DeSantis has announced plans to continue operations at Alligator Alcatraz, despite a ruling from U.S. District Judge Kathleen Williams that ordered the facility to shut down. This decision marks a significant challenge to the authority of the judiciary in immigration matters, as DeSantis indicated that Florida will soon open a second facility in the Jacksonville area.
On August 31, 2023, DeSantis expressed his determination to maintain operations at Alligator Alcatraz, which has been at the center of controversy regarding its treatment of undocumented immigrants. “We’re not gonna be deterred. We’re totally in the right on this,” he stated, emphasizing that deportations will continue despite the legal setbacks. His remarks followed a lengthy ruling from Judge Williams, which cited environmental concerns and access for the Miccosukee Tribe as reasons for the shutdown.
DeSantis criticized the 82-page ruling as lacking a solid basis in immigration law, asserting that it was influenced more by activist judicial perspectives than by legal precedent. This marks the second time Williams has attempted to halt operations at the facility, previously ordering a temporary shutdown due to concerns about wildlife in August 2023.
In response to the recent ruling, Florida filed an appeal, although DeSantis made clear that he would not pause operations while the matter is under judicial review. He reinforced Florida’s commitment to securing its borders and protecting citizens from illegal immigration, highlighting the ongoing success of the state’s Panhandle Immigration Enforcement Operation.
The Governor’s firm stance has drawn significant attention, particularly among supporters who see it as a testament to his leadership. “No stalling, no begging courts for permission, just action,” noted one supporter on social media. This sentiment reflects a broader trend among some political figures who advocate for aggressive measures regarding immigration enforcement.
Critics of the ruling, including DeSantis, argue that judges are overstepping their bounds in immigration matters, which they believe should be managed by elected officials rather than the judiciary. A notable point of contention is the reliance on regulations from the Council on Environmental Quality (CEQ), which several courts have previously ruled lacks statutory authority.
