Philadelphia Man Sentenced to 10 Years for Gun Possession
A Philadelphia man has been sentenced to ten years in federal prison after admitting to illegally possessing a loaded firearm while allegedly intending to carry out a retaliatory killing. Jeffrey Hernandez, aged 40, received the maximum sentence allowable under federal law this week, as announced by United States Attorney David Metcalf.
U.S. District Judge Wendy Beetlestone imposed the sentence of 120 months in prison, followed by three years of supervised release. Hernandez had pleaded guilty in August 2023 to the charge of illegal possession of a firearm as a convicted felon.
Details of the Case
Court documents reveal that Hernandez was found in possession of a 9mm semiautomatic pistol loaded with 30 live rounds. Prosecutors indicated that Hernandez was aware that he was prohibited from owning any firearm due to his previous felony conviction.
Federal investigators recovered the weapon after receiving credible intelligence suggesting that Hernandez and three accomplices were traveling to execute a retaliatory killing linked to a prior shooting incident. It is important to note that Hernandez was charged solely with the illegal possession of a firearm and not with any allegations regarding a plot for violence.
This case was a collaborative effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives, the FBI, and the Philadelphia Police Department. The prosecution was led by Assistant United States Attorney Ashley Martin and Special Assistant United States Attorney Meagan Gordon.
Implications and Conclusion
Hernandez’s sentencing underscores the seriousness with which federal authorities treat illegal firearm possession, particularly among individuals with prior felony convictions. The maximum penalty reflects the potential risks associated with firearms in the hands of individuals who have demonstrated a disregard for the law.
The case not only highlights ongoing concerns regarding gun violence but also illustrates the collaborative efforts of law enforcement agencies to address such issues in Philadelphia and beyond.
